Digital Succession Solutions Private Limited (hereinafter referred to as ‘DSSPL’'we', 'us', or 'our') operates this mobile and/or application-based platform under the brand name ‘Yellow’ (“Platform”). DSSPL, through the Platform, provides services pertaining to succession planning, including, without limitation, providing assistance in preparing wills and other allied documents pertaining to succession and estate planning (“Services”).

This Privacy Policy (“Policy”) applies to an individual who, whether acting personally or on behalf of any other person or an entity, accesses or uses the Platform and/or any Services provided therein, or otherwise is a visitor on the Platform (hereinafter referred to as 'you' or 'your' or ‘User’).

This Policy reflects our commitment towards protecting the Personal Information (as defined below), including Sensitive Personal Information/SPI (as defined below) (together, “Information”), provided by Users to us on the Platform (including any Information that a User may provide pertaining to his/her beneficiary(ies)/nominee(s), executor(s), witness(es), asset(s) (together, “User Representative(s)”) of/to his/her will created by availing any Services) in connection with the provision of the Services and sets out, among other things, the nature and type of Information we collect from Users, the usage, processing, treatment, storage, maintenance, transfer, sharing and disclosure of such Information, and the safety and security measures adopted by us to safeguard such Information. This Policy forms an integral part of DSSPL’s Terms and Conditions of Service (“Terms of Service”), published and made available on the Platform, and as available at: Terms of Service

Before you use the Platform or any Services or submit any Information on the Platform, please read this Policy to understand how we protect, collect, use, treat, process and share Information that you provide to or share with us.

Please note that this Policy is only applicable to the Users and the Information gathered or generated on the Platform and not to any other information or website/application/platform. You are hereby advised to read this Policy carefully and fully understand the nature, scope and purpose of gathering and/or collecting your Information, and the usage, processing, storage, treatment, maintenance, disclosure, transfer and/or sharing of such Information. By accessing or using any part of the Platform and/or the Services, you hereby consent to the collection, use, processing, storage, treatment, maintenance, disclosure, sharing and transfer of Information that you provide to us on or through the Platform, for the purposes outlined in this Policy and in accordance with the terms contained in this Policy and applicable laws.

If you do not agree to this Policy, please do not access or use the Platform or the Services. Your access to or use of any part of the Platform and/or the Services indicates your acceptance of this Policy and all the terms contained herein. While you have the option not to provide us with certain Information, request temporary suspension of collection of certain Information or request deletion of certain Information collected, kindly note that in such an event you may not be able to take full advantage of the entire scope of features and offerings, including the Services, offered to you by us on the Platform and in such instance we reserve the right to not provide you access to the Platform or any part thereof, including the Services or any part thereof.

1. This Policy explains, among other things:

  • The Information we may collect from you on/through the Platform;
  • How we collect the Information from you;
  • The purpose of collection of Information about you and the purposes for which such Information may be put to use;
  • How we may use the Information collected from you;
  • The use and role of cookies and similar technologies on the Platform;
  • How we will protect, maintain and use Information we collect from you;
  • The circumstances and situations in which we might disclose, transfer or share Information that you provide or share with us, to/with any third party;
  • When we may use Information that you provide or share with us to contact you; and
  • How you can ensure that the Information we hold as provided by you is accurate, valid, true and current.

2. Information Gathered

You may not be able to access significant portions, features and sections of the Platform or use the Services unless you login using your existing Account (as defined herein) credentials on the Platform and absent such credentials, create a new Account to register on the Platform and reveal/disclose your identity and/or other information about you, including Information, that we may require from time to time. Additionally, you will have to confirm that you have read and agreed to this Policy and Terms of Service.

Information that we collect from you at the time of your registration on the Platform, which shall be through creating an account on the Platform (“Account”), or at any other time will vary depending upon the activity you seek to engage in or the Services that you seek to avail, and in this respect, if you choose to sign up for/avail any of the Services, you may be required to provide, inter alia, the following information at the first instance:

  1. username;
  2. password, PIN, facial recognition, fingerprint and/or any other biometric information that we may require;
  3. name;
  4. address;
  5. religion;
  6. date of birth;
  7. contact details, including email address, mobile/contact number, residential address;
  8. information and details that we may require regarding your User Representative(s); and
  9. and information and documents that we may require with respect to the implementation of Know Your Customer (KYC) and User identification.

We collect and use information as follows: Personal details (name, email address, user IDs, home address, phone number, religion) for account setup, to populate users Will document, and for account and marketing communication and analytics; financial information including asset and investment details entered by user for populating Will document; contact list information to populate users beneficiary details into Will document; photos, videos, and documents for personalising users account and populating Will document; and app interaction and performance data (including crash logs) are used to improve app stability and user experience.

Once your Account is registered on the Platform, you can sign into your Account using your contact number, PIN, facial recognition and/or fingerprint (as the case may be) registered on the Platform and/or any other Personal Information that we may require from time to time for enabling you to sign in to your Account.

When you communicate with us using the ‘chat now’ feature and/or ‘talk to an expert’ feature available on the Platform (“Communication Mechanism(s)”) or otherwise, we may collect, record, process and store all or certain information, including Information, in relation to such communication. In addition, we may collect demographic information pertaining to you such as, without limitation, information about your mobile/computer, hardware, software, device, Internet Protocol (IP) address and connection, information about your online activity on the Platform such as Platform’s feature/offering usage and click paths, and other data/information that you may provide in surveys, opinion polls, research studies undertaken by or on behalf of us with respect to your Account profile and/or the Platform. We may combine your demographic information with Personal Information to tailor our offerings (including Services) or the Platform or any part thereof to your preferences or interests.

You may digitize, upload and store scanned copies of your Aadhar card, Permanent Account Number (PAN) card, driving license, voter ID card, passport and any other government-issued and recognized identity document, property papers, medical reports, medical certificates, and other documents, files, certificates and records containing Information required for availing any Services (together, “Personal Record(s)”). You hereby grant us the permission to access the Personal Record(s) that you may upload and store on the Platform to provide the Services to you and for such purposes as provided in this Policy and Terms of Service. 

You agree and undertake to upload only such copies of the Personal Record(s) as are necessary to avail any Services on the Platform. To the extent permitted by law, we shall not be liable in any manner whatsoever if you upload any document, file, certificate, records, information or content (whether or not containing any Information) to the Platform other than such copies of the Personal Record(s) as are necessary for the purpose of availing any Services on the Platform. 

You represent and warrant that you are in the possession and full ownership of all Personal Record(s) you upload and store on the Platform. We do not actively pre-screen any Personal Record(s) or any content thereof, but we reserve the right to refuse access to the Account or remove or delete or refuse temporary access to any Personal Record(s) uploaded and stored on the Platform at any time and for any reason whatsoever, including when any Personal Record(s) is found to be unlawful, forged, offensive, pornographic, infringing any right (including, without limitation, privacy rights) of any person or violating this Policy or Terms of Service.

3. Sensitive Personal Information

Sensitive Personal Information (“SPI”) means and includes such personal information which consists of information relating to your sexual orientation; password; religion; personal identification number (PIN); physical and mental health condition; medical records; biometric information such as, without limitation, fingerprint, facial recognition; Aadhar card and number, PAN card and number, voter ID, driving license number, passport ID and any other government-issued and recognised identity document and number; financial information (such as bank account details, payment instruction details, billing details, digital wallet details, credit card numbers, etc.); demat account details, fixed deposit account details, e-wallet and crypto-wallet details, information regarding investments including, without limitation, real estate investments, mutual funds’ investments, stock investments; information that you may provide us for/while availing any Services which is in the nature of SPI; any document, data, papers, including your will, embodying the aforesaid information and any copies thereof, and such other information specified as constituting SPI under the applicable laws of India.

Except for any SPI that you choose to upload and store on the Platform or provide as part of your Account profile or in the course of transacting on the Platform, including in the course of availing any Services or as otherwise provided in this Policy or Terms of Service, we do not collect any SPI in the course of providing the Services. Any SPI collected by us shall not be disclosed to any third party without your express consent, save as otherwise set out in this Policy or Terms of Service or as provided in a separate written agreement between DSSPL and you or as required by law. You agree and understand that this condition shall not apply to publicly available information, including SPI, in relation to you on the Platform.

However, you acknowledge that in the course of providing the Services, we may receive SPI, either when you voluntarily choose to provide the SPI, update your Account profile with information related to your identity or any other information in the nature of SPI, or from such content, photos or documents posted or uploaded by you on the Platform, and you hereby consent and agree to allow DSSPL to collect, use, process, treat, maintain, store and display the SPI collected in this manner on the Platform and disclose it in accordance with the terms of this Policy and Terms of Service.

It is clarified that with respect to any SPI pertaining to you that you may share with us, you have the sole right to determine whether you want to share such SPI with us. 

4. Personal Information

“Personal Information” means and includes any and all information that may be used to identify you, including, but not limited to, your first and last name, date of birth, signature (including digital signature), contact details (including email address, mobile/contact number, place of residence and residential address), marital status, voice recording(s), video recording(s), any communication that you make with us or our representative(s) using any Communication Mechanism(s), photograph, testimonials that you may provide to us regarding your use of/experience with the Platform and/or Services, signature, any document, data, papers embodying the aforesaid information and any copies thereof.

We may collect Personal Information from you when you register and create an Account profile on the Platform, avail any Services, or otherwise when you voluntarily provide such Personal Information to us, or otherwise as provided in this Policy or the Terms of Service. Further, we may use the Personal Information in order to verify your credentials, for the purpose of permitting continued access to the Services, to contact you in the course of rendering the Services or otherwise for such purposes as mentioned in this Policy or the Terms of Service.

5. Cookies and Other Tracking Technologies

The Platform or any part thereof may utilise data collection tools such as “cookies” and other tracking technologies. A “cookie” is a small text file that may be used, for example, to collect information about your activity on the Platform. Some cookies and other technologies we use may serve to save and/or recall  Information previously indicated/provided by you on the Platform. Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. You may set/update the settings of most browsers to notify you if you receive a cookie, or you may choose to block cookies by modifying the settings within your browser, however please note that if you choose to erase or block your cookies, you may need to re-enter your Information each time you try to gain access to certain parts of the Platform. Further, while the option of accepting cookies is up to you, however certain features of the Platform including the Services may not be accessible without accepting cookies. If you choose to eliminate cookies, the full functionality of the Services may be impaired for you.

Additionally, you may encounter cookies or other tracking technologies on the Platform or any part thereof that are placed by third parties. We do not control the use of cookies and other tracking technologies by third parties and shall not be liable for any reason whatsoever for the third-party cookies and other tracking technologies placed on the Platform or any part thereof.

Cookies and tracking technologies may automatically collect, record and store certain information, including without limitation, your electronic device’s connection to the internet; your Internet domain and host names; other information about your geographic location and IP addresses; your browser’s software and operating system types; your CPU type; your manner of connecting to the Internet (e.g., connection speed through narrowband or broadband access); click paths; and dates and times that the Platform is accessed. Such information does not identify the User personally.

Our use of cookies and other tracking technologies allows us to improve the Platform, tailor the Platform and its usability to the interests of the Users, remember choices you make (such as User/Account name, email address, phone number, any Information that you provide for/while availing the Services etc.), deliver content that is most relevant to you and your interests, and improve and enhance your experience using the Platform and the Services. We may also analyse information that does not include Information for measuring traffic, User activity on the Platform, trends and statistics.

6. Uses of Information 

We may use Information and other information received or collected from you:
(i) to provide the Services you have requested;
(ii) to enable you to access and update your profile on your Account;
(iii) to contact you upon your request, respond to your queries, requests or complaints or when otherwise necessary;
(iv) for auditing, research and analysis;
(v) to operate and improve the Services and Platform;
(vi) to facilitate your use of the Platform and Services;
(vii) to conduct internal reviews and data analysis for the Platform and the Services; (viii) for sending you surveys and marketing communications;
(ix) to notify you about any changes to our Services, this Policy or any terms or policies applicable to the Platform and/or Services;
(x) to engage in technical maintenance and trouble-shooting problems and errors associated with the Platform;
(xi) to manage your transactions with us on the Platform;
(xii) to protect the integrity of the Platform;
(xiii) for testimonials and other promotions;
(xiv) complying with applicable laws;
(xv) for implementing KYC and User Identification;
(xvi) to contact User Representative(s) in connection with the provision of Services; and
(xvii) as otherwise set forth in this Policy, or Terms of Service or any terms or policies applicable to the Platform and/or Services. In certain circumstances as may be solely determined by us, we may share Information received or collected from you, in a non-personally identifiable manner with third parties such as our business partners. When we use third parties to assist us in processing any Information received or collected from you, we require that they comply with this Policy and any other appropriate confidentiality and security measures.

It is hereby clarified that any information you provide to us regarding User Representative(s) for the purpose of availing any Services shall not be used by us for any purpose other than for the provision of Services, or as required to comply with any applicable law or for such other purposes as provided under this Policy or Terms of Service.

You acknowledge that in the course of/with respect to your use of the Platform and/or Services we may receive your Personal Information, when you choose to provide such Personal Information (either through a testimonial or through emails sent to us) related to your use of/experience with the Platform and/or Services, and you hereby consent and agree to allow us to store and display the Personal Information (including without limitation, your name, place of residence, photograph and testimonial) collected in this manner on the Platform and disclose it on the Platform in accordance with the terms of this Policy.

Where we propose to use any Information received or collected from you for any uses or purposes other than as specified in this Policy, we will ensure that we notify you first. You will also be given the opportunity to withhold or withdraw your consent for your use of Information that you share with us other than as listed under this Policy.

7. Confidentiality and Security

We will keep confidential and protect the Information you provide except where disclosure is required or permitted by law, or in instances where we have a good-faith belief that it is necessary to comply with a court order, legal obligation, legal process, request from government or judicial authorities, or to exercise our legal rights or defend against legal claims or to detect, prevent, or otherwise address security, fraud, forgery, imminent harm or technical issues, or to enforce this Policy, Terms of Services and any other policies pertaining to the Platform, including investigation of any potential violation thereof, or where use and disclosure thereof has been permitted by you or is otherwise permitted under this Policy or Terms of Service.

We follow generally accepted industry standards and legally mandated safeguards to protect and safeguard the Information submitted to us, both during transmission and, once we receive it, for storage and disposal. All Information we gather is securely stored within databases controlled by us. The databases are stored on servers secured behind a firewall; access to the servers is password protected and is strictly limited. However, no data transmission over the Internet, or method of electronic/data storage, is 100% secure and no security system is impenetrable. Nonetheless, we will strive to use commercially acceptable means and legally mandated safeguards to protect any Information that you may share with us.

Notwithstanding anything contained in this Policy, we shall not be held responsible for any loss, damage or misuse of any Information if such loss, damage or misuse is attributable to a Force Majeure Event. A “Force Majeure Event” shall mean any event that is beyond the reasonable control of DSSPL and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, unavailability of any communication system, acts of governmental or judicial authority, hacking of the Platform or any part thereof, unauthorized access to the Platform’s data, technical snags/failures and breach of Platform’s security and encryption.

We limit access to the Information that you provide to or share with us to our employees, agents, representatives, personnel and service providers whom we believe reasonably need access to such Information to provide Services to you.

You hereby consent to DSSPL sharing Information with its affiliates for the purpose of the provision of the Services, for research, promotional and advertising activity, data analytics, as well as such other purposes as may be notified to you, at the time of collection of Information from you, from time to time.

We may engage third party service providers to help us provide certain services to you on our behalf, including with respect to implementing KYC and User identification. We may provide/share Information that you share with us, to such third-party service providers to help us deliver Services efficiently and effectively. We may also engage third party service providers to maintain, improve or optimize the Platform, Services and/or mailing lists. We will take reasonable steps to ensure that these third-party service providers are obligated to protect Information on our behalf, by entering into confidentiality agreements with such third party service providers or otherwise. We do not intend to transfer any Information that you share with us without your consent to third parties who are not bound to act on our behalf unless otherwise provided herein or such transfer is legally required. Similarly, it is against our policy to sell any Information collected from you on the Platform without your consent.

If you choose to provide us with any Information, you understand and agree that we may use, transfer, process and/or store that Information from your country or jurisdiction to other countries or jurisdictions around the world in accordance with applicable laws, and that our affiliates and service providers may also, subject to applicable laws, use, transfer, process and/or store the Information in jurisdictions other than India. Any Information that you provide may be collected and stored on servers located in the territory of India and such other countries as we may disclose from time to time. 

8. Retention

We retain the Information that you share with or provide to us in accordance with applicable laws, for a period no longer than is required for the purpose for which it was collected or as required under any applicable law. However, we may retain Information that you share with or provide to us if we believe it may be necessary to prevent fraud or future abuse, to enable us to exercise our legal rights and/or defend against legal claims or if required by law or for other legitimate purposes. We may continue to retain Information that you provide to or share with us in anonymised form for analytical and research purposes and for such purposes as provided herein and in the Terms of Services.

9. Third Party Platforms and Services

The Platform may contain links, references, and content from third party websites, applications or services (“External Resources”) outside of our control. Your visit to or interaction with any External Resource, including any information provided by you therein, irrespective of whether the link to such External Resource originated on the Platform, is governed by the terms and privacy policies of such External Resource, and your interaction with any External Resource is outside the purview of our control and is at your own risk. Since we cannot control the activities of External Resources, we cannot accept responsibility for any collection, use, treatment, processing, maintenance, disclosure, transfer and management of your information by such External Resources, and we cannot guarantee that they will adhere to the same privacy and security practices as we do. We are not responsible for the functionality, security measures, privacy practices or the content of External Resources and this Policy will not govern your access or use of any External Resources that you visit or use. Therefore, if you visit any External Resource, irrespective of whether the External Resource is linked or referenced to the Platform, you should consult that External Recourses’ privacy policy and terms before providing any information therein.

10. Contacting You

We may contact you using the Information you have given us:

  • To facilitate any of your Services transactions on the Platform;
  • In relation to ensuring that we can facilitate the delivery of the Services to you;
  • Where you have issued a query or requested information from us; 
  • To address/redress any grievances you may have;
  • Where you have opted to receive further correspondence;
  • To invite you to participate in surveys, opinion polls, testimonials etc., about the Platform, Services or otherwise (participation is always voluntary);
  • To provide you information about our products and/or services, including new products and/or new services, and other marketing communications, where you have specifically agreed to receive this.

11. Change of Control

In the event that ownership or control of DSSPL was to change or in the event DSSPL sells or transfers all or a portion of its business, or its assets, to another entity (e.g., in the course of a transaction like a merger, acquisition or similar transaction), the Information that you provide or share with us may be transferred, shared, disclosed, sold or assigned as part of the transaction. You hereby expressly grant consent and permission to DSSPL for transferring, sharing, disclosing, selling or assigning, as the case may be, any Information that you share with or provide to us, to such transferee or buyer. Such transferee or buyer would be obliged to honour the commitments made in this Policy. If such a transfer, sharing, disclosure, sale or assignment results in a material change in the nature of use of Information, DSSPL will provide you notice about the choices you have to decline to permit such a transfer, sharing, disclosure, sale or assignment of Information.

12. Accuracy, Authorization and Updating Information

DSSPL shall not be liable, in any manner, for any reason and under any circumstance whatsoever, for the authenticity, correctness, trueness, validity or accuracy of any Information or Personal Record(s) provided/shared by you on the Platform, or while availing any Services. You hereby warrant and confirm that any Information and Personal Record(s) you provide or share on the Platform or while availing any Services is and shall continue to be valid, true, current and accurate to the best of your knowledge.

Where you disclose or share any data or information of any User Representative(s) or third parties on the Platform or while availing any Services, you warrant that you have procured and obtained the relevant User Representative(s)/third party’s consent, permission and approval as may be required under applicable laws for such disclosure or sharing of the relevant User Representative(s)/third party’s data or information and that the User Representative(s)/third party has been informed of, and agrees to, this Policy and Terms of Service and any lawful uses we may make of such data or information for the provision of Services and for such purposes as provided herein and in the Terms of Service.

You agree to, at your own expense, protect, indemnify, defend and hold us harmless from and against all losses, liabilities, claims, demands, suits, actions, judgments, costs, expenses and damages (including reasonable legal fees and expenses) arising from or relating to, directly or indirectly, in whole or in part any claim or allegation that any Information or Personal Record(s) shared or provided by you on the Platform infringes any right (including, without limitation, privacy rights) of any person.

If any Information or Personal Record(s) that you provide or share on the Platform is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or if we have reasonable grounds to suspect or believe that such Information or Personal Record(s) is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your Account and refuse any and all current or future use of the Platform or any Services provided therein at our sole discretion, in addition to any right that we may have against you at law or in equity, for any misrepresentation of Information or Personal Record(s) provided or shared by you.

To the extent that you do provide us with any Information, we wish to maintain accurate and current Information. Where we collect any Information from you on the Platform or where you provide any Information to us on the Platform, should you need to update or correct that Information, please contact us and we will make reasonable efforts to incorporate the changes in the relevant Information that we hold as soon as practicable. You can obtain the Information we currently hold about you by emailing us at helpdesk@getyellow.in. We will use our best efforts to send you the requested Information within a reasonable period of time. Notwithstanding the foregoing if you wish to correct or update any document containing Information and uploaded by you to the Platform, you may correct or update such Information directly by uploading the updated document to the Platform, and you agree to notify us immediately about such updation by emailing us at helpdesk@getyellow.in.

13. Protection of Account Information and Password

You are solely responsible for any activity under your Account, and you are responsible for maintaining strict confidentiality of your Account and its credentials. It is your sole responsibility to control access to and use of your Account. Any breach of this provision constitutes a violation of this Policy and may result in termination of your Account. If you become aware of or reasonably suspect any breach of security of your Account, including compromise of your Account password(s), you must notify us immediately. We will not be responsible or liable to you or claiming through you for any loss or damage arising from your failure to comply with the obligations stated in this provision.

14. Conditions of Use

We do not warrant that the Platform, it's servers, or emails sent by us or on our behalf are virus free. We will not be liable for any damages of any kind arising from the access or use of the Platform or the Services, including, but not limited to compensatory, direct, indirect, incidental, punitive, special and consequential damages, loss of data, goodwill, opportunity, income or profit, loss of or damage to any asset or property and claims of third parties.

15. Restriction on use of the Platform and Services

Use of our Platform and Services is available only to persons who are above eighteen (18) years of age, are of a sound mind, are using the Platform out of their own volition and are not disqualified from contracting by any law to which the persons are subject. As a minor, if you wish to use or transact on the Platform, such use or transaction shall only be made by a person of legal contracting age (legal guardian or parent). We reserve the right to block access to the Platform if it is discovered that you are a minor or incompetent to contract according to the applicable laws. Subject to the foregoing, we do not knowingly solicit or collect Information from children under the age of eighteen (18) years. In the event that we learn that we have collected Information from a child below the age of eighteen (18) years in violation of this Clause 15 or from a person who is incompetent to contract according to applicable laws, we will endeavour to delete that Information as quickly as possible. If you believe that we might have any Information from a child below the age of 18 years in violation of this Clause 15 or from a person who is incompetent to contract according to applicable laws, please contact us at: helpdesk@getyellow.in

16. Termination of User Account

In the event that you choose to terminate or delete your Account, or if your Account has been terminated by us for any reason, including without limitation, for violation of the Terms of Service or this Policy, we shall within a reasonable period of time and subject to the terms contained herein, delete and remove all the Information that you may have submitted to us and which is in our possession. You acknowledge and agree that anonymized or non-personally identifiable information pertaining to you and as available with us may continue to be used, processed, stored, maintained, disclosed and/or displayed by DSSPL or its affiliates, service providers and third parties as a part of any surveys or research or tabulations compiled on the Platform or for any other purpose whatsoever in accordance with applicable laws.

17. Amendments

We may amend this Policy from time to time, which amendments will be posted on this page, and we will, in accordance with applicable laws, inform you with details of the amendments. However, you are advised to review this Policy periodically by visiting this page, as your continued access to or use of the Platform and/or the Services following the posting of any amendments to this Policy on this page will constitute your binding acceptance of such amendments and the updated Policy.

18. Severability

The invalidity or unenforceability of any provision of this Policy, in whole or in part, in any jurisdiction shall not affect the validity, legality or enforceability of the remainder of this Policy in such jurisdiction and this Policy shall continue to operate to its fullest extent, permissible under law.

19. Applicable Law and Jurisdiction
